What's Up ?

On January 30, the U.S. District Court, Central District of California, in the case, California Medical Association v. Toby Douglas and Kathleen Sebelius, held oral argument and issued a tentative decision to grant a preliminary injunction that would enjoin DHCS from implementing AB 97 and reducing Medi-Cal payments for services provided by physicians, clinics, dentists, pharmacists, ambulance providers, and providers of medical supplies and durable medical equipment on or after June 1, 2011.  The tentative ruling also proposed to stay U.S. Department of Health and Human Services Secretary Sebelius' approval of California's State Plan Amendments to implement these AB 97 payment reductions.  On January 31, U.S. District Judge Christina Snyder granted the preliminary injunction and denied DHCS' motion for a stay pending an appeal.  DHCS plans to appeal the ruling.
